The Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 govern the importation and exportation of hazardous and other wastes in and out of India. The importation of hazardous waste into India is highly prohibited for disposal but can be allowed for recycling, recovery, reuse, or co-processing.
Any company that engages in the importation or exportation of products such as lead scrap, used batteries, waste tyres, used oil, or electronic assemblies cannot do anything without the official approval of the MoEFCC. This permission ensures that the imported wastes are being utilized in a responsible manner and for legitimate use.
Permission applications are to be made in the prescribed format to the MoEFCC along with supporting documents. The importer or exporter must keep meticulous records of the waste being handled and provide yearly returns to the State Pollution Control Board.
Some small samples may not require import permission such as those imported for testing or research in quantities of up to 1000 grams or 1000 millilitres. Customs and port officials ensure that all shipments contain the necessary documents and test reports obtained from an accredited laboratory.
For items listed in Part A of Schedule III, imports and exports must have prior informed consent of the exporting country and permission from MoEFCC. Items listed in Part B of Schedule III require MoEFCC permission only. Used electrical and electronic assemblies also fall in this category and must be authorized under EPR.
Exports classified under Part A and B of Schedule VI may only be done with MoEFCC approval. Items under Part D of Schedule III can be imported without prior MoEFCC approval.
Wastes identified as hazardous under Part C of Schedule III must receive written permission from MoEFCC for both import and export.
Wastes mentioned in Schedule VI are strictly prohibited for import under any circumstances.
